These Terms of Service ("Terms") govern your use of the WebCraft Digital website and the web design and development services we provide. By engaging our services, you agree to these Terms.
1. Services
WebCraft Digital provides custom website design, development, and ongoing maintenance services for local service businesses. Specific deliverables, timelines, and pricing are outlined in individual project agreements or proposals communicated directly to each client.
2. Free Preview
We offer a complimentary website preview built within 48 hours of your initial inquiry, at no cost and with no obligation. The preview is intended to demonstrate our design capabilities for your specific business. No payment is required to view your preview.
3. Payment Terms
Payment terms are agreed upon before project commencement. Payment is due according to the schedule outlined in your project agreement. All fees are in USD. We reserve the right to suspend work or withhold delivery of final files until payment is received in full.
4. Client Responsibilities
To complete your project, you agree to:
- Provide accurate business information when requested
- Review and provide feedback within a reasonable timeframe
- Ensure you have rights to any logos, photos, or content you supply
- Cooperate with domain setup and hosting instructions
5. Intellectual Property
Upon receipt of full payment, you own the final website design and content created specifically for your project. We retain the right to display your website in our portfolio and use it as a work sample unless you request otherwise in writing.
6. Ongoing Maintenance
Monthly maintenance at $25/month covers routine updates, content changes, security patches, and performance checks. Maintenance is billed monthly and may be cancelled with 30 days written notice. We are not responsible for issues caused by third-party platform changes outside our control.
7. Limitation of Liability
WebCraft Digital is not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim arising under these Terms shall not exceed the total amount paid by you for the specific service giving rise to the claim.
8. No Guarantee of Results
While we follow best practices for SEO and conversion optimization, we do not guarantee specific search engine rankings, traffic levels, or revenue outcomes. Website performance depends on many factors outside our control.
9. Third-Party Services
We may recommend or integrate third-party services (domain registrars, hosting providers, analytics tools). These services are governed by their own terms and privacy policies. We are not responsible for third-party service interruptions or policy changes.
10. Termination
Either party may terminate a project agreement with written notice. If you terminate after work has commenced, you are responsible for payment for work completed to date. We reserve the right to terminate our services if you violate these Terms.
11. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
